The Judge's Bench: November UCMJ actions Published Dec. 8, 2011 7th Bomb Wing Judge Advocate DYESS AIR FORCE BASE, Texas -- The following airmen assigned to Dyess Air Force Base received non-judicial punishment under Article 15 during the month of November: A 7th Aircraft Maintenance Squadron senior airman received an Article 15 for failure to attend a mandatory medical evaluation. Punishment consisted of a reduction to airman first class and a reprimand. A 7 AMXS senior airman received an Article 15 for using a Schedule I controlled substance known as "Spice". Punishment consisted of a reduction to airman basic and a reprimand. A 7 AMXS airman first class received an Article 15 for making a false official statement and failure to pay a debt. Punishment consisted of a reduction to airman, suspended 30 days extra duty and a reprimand. A 7th Component Maintenance Squadron senior airman received an Article 15 for wrongfully using Marijuana. Punishment consisted of a reduction to airman basic and a reprimand. A 7 CMS senior airman received an Article 15 for failure to appear for a final inspection of base housing and failure to maintain sufficient funds. Punishment consisted of a reduction to airman first class, suspended reduction to airman and suspended forfeiture of $822 pay per month for two months. A 7th Civil Engineering Squadron staff sergeant received an Article 15 for being drunk and disorderly. Punishment consisted of a suspended reduction to senior airman and a forfeiture of $500. A 7 CES senior airman received an Article 15 for signing a false official record. Punishment consisted of a reduction to airman first class, suspended reduction to airman and a reprimand. A 7 CES airman first class received an Article 15 for underage drinking. Punishment consisted of a reduction to airman and a suspended forfeiture of $822. A 7th Force Support Squadron senior airman received an Article 15 in October 2011 with a suspended reduction to airman first class for failing to wear the proper uniform to work. In November 2011 the senior airman's suspended punishment was enforced for not scheduling a fitness assessment. A 7th Logistics Readiness Squadron staff sergeant received an Article 15 for stealing merchandise at the Base Exchange. Punishment consisted of a reduction to senior airman, forfeiture of $1,162 and a reprimand. A 7th Maintenance Operations Squadron airman received an Article 15 for underage drinking. Punishment consisted of a suspended reduction to airman basic, 30 days extra duty and a reprimand. A 7th Security Forces Squadron staff sergeant received an Article 15 for using a Government Travel Card for unauthorized purchases and failure to pay debt. Punishment consisted of forfeitures of $150 pay per month for two months, 30 days extra duty and a reprimand. A 40th Airlift Squadron captain received an Article 15 for failure to obey a no contact order. Punishment consisted of forfeiture of $2,947 pay per month for two months and a reprimand. A 317th Aircraft Maintenance Squadron senior airman received an Article 15 for failure to attend a mandatory physical training session. Punishment consisted of a suspended reduction to airman, forfeiture of $586, 30 days extra duty and a reprimand. A 337th Test and Evaluation Squadron captain received an Article 15 for driving while drunk and having an open container while driving. Punishment consisted of forfeiture of $1,500 pay per month for two months, suspended forfeiture of $1,224 pay per month for two months and a reprimand. The military justice system is a commander's program designed to support good order and discipline in the unit and to ensure mission accomplishment. One important aspect of the military justice system is non-judicial punishment under Article 15 of the Uniform Code of Military Justice. When commanders decide to impose non-judicial punishment, they can choose from a variety of punishments. For enlisted members, the list includes reduction in rank, forfeiture of pay, restriction, extra duties and a reprimand. Officers can receive forfeiture of pay, arrest in quarters, restriction and a reprimand. When using non-judicial punishment, commanders take into account the member's duty performance, attitude, potential and disciplinary history.
