ARTICLE 15 (NON-JUDICIAL PUNISHMENT) SUMMARY
Commanders are responsible for good order and discipline in their commands. Generally, discipline can be maintained through effective leadership including, when necessary, administrative corrective measures. Non-judicial punishment is ordinarily appropriate when administrative corrective measures are inadequate due to the nature of the minor offense or the record of the service member, unless it is clear that only trial by court-martial will meet the needs of justice and discipline. Non-judicial punishment shall be considered on an individual basis. Commanders considering non-judicial punishment should consider the nature of the offense, the record of the service member, the needs for good order and discipline, and the effect of non-judicial punishment on the service member and the service member’s record.
A commander who is considering a case for disposition under Article 15 will exercise personal discretion in evaluating each case, both as to whether non-judicial punishment is appropriate, and, if so, as to the nature and amount of punishment appropriate.
TSgt: Member made several inappropriate sexual comments to coworkers. He also acted in a disorderly manner by throwing a bottle of sanitizer at someone. He received an Article 15 for violations of Articles 92 and 134. He was punished with reduction to the grade of Staff Sergeant, suspended, forfeiture of $250.00 pay per month for 2 months, and a reprimand.
SSgt: Member repeatedly failed to follow Technical Order guidance. He received an Article 15 for violations of Article 92. He was punished with reduction to the grade of Senior Airman, 14 days extra duty, suspended based on the additional condition that he brief safety and the importance of Technical Orders at roll calls, and a reprimand.
SSgt: Member failed to follow Technical Order guidance while performing maintenance, and provided a false statement when confronted about his actions. He received an Article 15 for violations of Articles 92 and 107. He was punished with a reduction to the grade of Senior Airman, forfeiture of $1,298.00 pay per month for two months, suspended, and a reprimand.
SSgt: During a TDY, the member went out drinking with an underage Airman who he knew to be underage. When questioned about the incident, member provided a false statement. He received an Article 15 for violation of Articles 92 and 107. He was punished with a reduction to the grade of Senior Airman, and a reprimand.
SrA: During a TDY, the member gave his ID to an underage Airman, which the Airman used to purchase alcohol and enter a nightclub. When questioned about the incident member provided a false statement. He received an Article 15 for violation of Articles 107 and 134. He was punished with a reduction to the grade of Airman First Class with reduction to the grade of Airman suspended, and a reprimand.
A1C: During a TDY, the member drank alcohol underage. He used someone else’s ID to enter a local nightclub and consumed more alcohol. When questioned about the incident, the member provided several false statements. He received an Article 15 for violations of Article 92, 107, and 134. He was punished with reduction to the grade of Airman, forfeitures of $918.00 pay per month for two months, with one month suspended, and a reprimand.
A1C: Member touched a female on her buttocks while she was asleep, without her permission. He received an Article 15 for violation of Article 120. He was punished with a reprimand. Discharge proceedings were subsequently initiated.
AB: The day after being served with an Article 15, member failed to show for several appointments. He received another Article 15 for violation of Article 86. He was punished with restriction to the limits of Dyess AFB, forfeitures of $819 pay per month for two months, suspended, and a reprimand. Discharge proceedings were subsequently initiated.
