COURTS-MARTIAL SUMMARY

TSgt. Member was accused of sexually assaulting a junior Airman while TDY OCONUS. He was court martialed for violations of Article 120 (Sexual assault) and found guilty by a panel of Air Force officers. He was sentenced to confinement for 12 months, reduction to the rank of Airman Basic, and a dishonorable service characterization discharge.

ARTICLE 15 (NON-JUDICIAL PUNISHMENT) SUMMARY

Commanders are responsible for good order and discipline in their commands. Generally, discipline can be maintained through effective leadership including, when necessary, administrative corrective measures. Nonjudicial punishment is ordinarily appropriate when administrative corrective measures are inadequate due to the nature of the minor offense or the record of the servicemember, unless it is clear that only trial by court-martial will meet the needs of justice and discipline. Nonjudicial punishment shall be considered on an individual basis. Commanders considering nonjudicial punishment should consider the nature of the offense, the record of the servicemember, the needs for good order and discipline, and the effect of nonjudicial punishment on the servicemember and the servicemember’s record.

A commander who is considering a case for disposition under nonjudicial punishment will exercise personal discretion in evaluating each case, both as to whether nonjudicial punishment is appropriate, and, if so, as to the nature and amount of punishment appropriate.


TSgt: Member acted unprofessionally with junior Airmen in that he would have them come over to his house at night to watch movies. He also sent improper text messages to young Airmen. Member was counseled to discontinue these unprofessional relationships but refused to do so. He received an Article 15 for violation of Article 92 (Failure to obey order or regulation). He was punished with a reduction to the rank of Staff Sergeant, forfeiture of $1,562.00 pay per month for two months (suspended), and a reprimand. Member appealed his Article 15 punishment, which was denied.

SSgt: Member failed to go at the time prescribed to his appointed place of duty. Additionally, member failed to stay awake at work on multiple occasions. He received an Article 15 for violations of Articles 86 (AWOL) & 92 (Failure to obey order or regulation). He was punished with a reduction to the rank of Senior Airman (suspended) and a reprimand.

SrA: Member failed to return four M-9 pistols and four M-4 carbines to the armory. He received an Article 15 for the violation of Article 92 (Failure to obey order or regulation). He was punished with a reduction to the rank of Airman 1st Class (suspended), forfeiture of $1,088 pay, thirty days of extra duty and a reprimand.

A1C: Member ingested a copious amount of cold medication to “get high.” Member had to be rushed to the hospital and treated for a potential overdose and suicide attempt. He received an Article 15 for the violation of Article 92 (Failure to obey order or regulation). He was reduced to the rank of Airman Basic (with reduction below the rank of Airman suspended) and a reprimand. Discharge proceedings were subsequently initiated.

A1C: Member failed to obey a lawful order on diverse occasions to have no contact with his spouse. He received an Article 15 for the violation of Article 92 (Failure to obey order or regulation). He was punished with a reduction to the rank of Airman and a reprimand.

A1C: Member failed to stay awake while on duty. He received an Article 15 for the violation of Article 92 (Failure to obey order or regulation). He was punished with a reduction to the rank of Airman and fourteen days of extra duty.

A1C: Member obtained off duty employment without first obtaining her squadron commander’s approval, as was required. Furthermore, she made false official statements when asked about her off duty employment. She received an Article 15 for violations of Articles 92 (Failure to obey order or regulation) & 107 (False official statement). She was punished with a reduction to the rank of Airman, forfeiture of $918.00 pay per month for two months (suspended) and a reprimand.

A1C: Member was drunk at an airport and negligently missed a movement by not making his connecting flight. He received an Article 15 for violations of Articles 87 (Missing movement) & 134 (Drunkenness). He was punished with forfeiture of $965.00 pay per month for two months (one month suspended), 5 days of extra duty, and a reprimand.


ADMINISTRATIVE DISCHARGE SUMMARY

SrA: Member was administratively discharged for Misconduct – Minor Disciplinary Infractions. His disciplinary history consisted of placement on a Control Roster, establishment of an Unfavorable Information File, three Letters of Reprimand (LOR), and three Letters of Counseling. He was discharged with a General service characterization.

A1C: Member was administratively discharged for Fraudulent Enlistment. His disciplinary history consisted of one LOR. He was discharged with a General service characterization.

A1C: Member was administratively discharged for Conditions That Interfere with Military Service – Personality Disorder or Mental Disorder not Constituting a Physical Disability. He was discharged with an Honorable service characterization.

A1C: Member was administratively discharged for Misconduct – Sexual Assault. His disciplinary history consisted of one Article 15 punishment. He was discharged with a General service characterization.

Amn: Member was administratively discharged for Misconduct – Drug Abuse. His disciplinary history consisted of one Article 15 punishment. He was discharged with a General service characterization.

ADMINISTRATIVE DEMOTION SUMMARY
